Creditors' Rights Practice Group

The Creditors' Rights Practice Group of Johnston, Allison & Hord has been in place for 17 years. We have expertise in remedies available in both state court and bankruptcy court, including small claims actions, district court and superior court actions, motions for relief from stay, foreclosures, attachment proceedings, garnishment proceedings, receiverships and supplemental proceedings. Our group answers a broad range of client needs, from assistance with occasional bad debt to high-volume collection services and representation in the bankruptcy forum.

In the area of collections, the group provides highly automated data processing capabilities that are easily integrated with our clients' systems and allow them to out-source management of past-due accounts receivable. Creditors with a large amount of collection referrals may transfer accounts electronically (via tape or modem) to our paperless collection system, which allows our professionals to handle accounts timely and efficiently.

Our practitioners are fully versed in the Bankruptcy Code, Truth in Lending Act, Fair Debt Collection Practices Act and other consumer regulatory schemes.
